Senators captain Brady Tkachuk is set to be suspended one game after he received an instigator penalty with less than 5 minutes left in regulation.
Tkachuk Receives Automatic Suspension
Tkachuk fought Sabres forward Alex Tuch late in the game tonight and it could get him in big trouble. The on-ice officials gave Tkachuk an instigator penalty on the play which carries an interesting bonus punishment in this case. Since the play happened with less than 5 minutes left in regulation, Tkachuk is set to receive a one-game suspension automatically.
Per NHL rule 46.21, Brady Tkachuk is set to be suspended for 1 game for receiving an instigator penalty in the last 5 minutes of regulation, while Head Coach DJ Smith would receive a $10,000 fine.

The Senators will appeal the suspension and there is a good chance it will be overturned given the fact that Tuch did shove Tkachuk before the fight. The rule exists to prevent goons from forcing their way into fights right as games are ending or even after the final whistle. This instance does not satisfy those conditions so as it is technically still a violation, the league may very well look the either way.
