Indeed, we learned new details about the circumstances of the incident that occurred on August 29th.
The 43-year-old New Jersey native, who mentioned at the time of his arrest that he only had "five or six beers," had 0.087% alcohol in his blood when he was arrested.
During the hearing, Judge Michael Silvano stated that the driver's faculties were impaired and that he didn't even see the Gaudreaus when he decided to make the dangerous maneuver on the road:
"His operation was so impaired he didn't even see these two young men," Silvano said. "Due to his impatience. In his own statement, he said he has issues with impatience on the roadway."
Higgins' attorney, Matthew Portella, stated that the sobriety tests could not be used because Higgins had undergone knee surgery just a week before the incident.
He added that Higgins was panicking at the scene before telling the police officers everything that had happened.
"Everybody has lost and is losing," Portella said.
Portella's attempt to victimize Higgins might resonate with a judge, but it will never help the Gaudreau family recover from this terrible crime.
Now more than ever, we need to keep the family in our thoughts as they go through this tough legal process.
